Decisione finale dell'Amministrazione federale delle contribuzioni (AFC) in materia di assistenza amministrativa Ai sensi dell'articolo 5 capoverso 3 lettera b dell'Accordo di cooperazione del 14 febbraio 2013 tra la Svizzera e gli Stati Uniti d'America per l'applicazione agevolata della normativa FATCA (Accordo FATCA; RS 0.672.933.63), l'AFC comunica quanto segue: 1.

Con scritti del 29 dicembre 2021, l'autorità competente degli Stati Uniti d'America (Internal Revenue Service; di seguito: «IRS»), ha richiesto all'AFC assistenza amministrativa giusta l'articolo 5 Accordo FATCA e l'articolo 26 della Convenzione del 2 ottobre 1996 tra la Confederazione Svizzera e gli Stati Uniti d'America per evitare le doppie imposizioni in materia di imposte sul reddito (CDI CH-US; RS 0.672.933.61) nella versione emendata dal Protocollo del 23 settembre 2009.

È richiesto di fornire informazioni riguardanti dei conti identificati come conti americani o conti di istituti finanziari non partecipanti ai quali sono stati versati degli importi esteri soggetti a notifica, che l'istituto finanziario Banca SYZ SA, in mancanza del consenso alla comunicazione dei dati del conto, ha comunicato all'IRS in forma aggregata per l'anno 2020 ai sensi dell'articolo 3 capoverso 1 lettera b (iii) e capoverso 2 lettera a (ii) dell'Accordo FATCA.

In data 11 febbraio 2022, le persone americane indicate e gli istituti finanziari non partecipanti interessati da una o più domande raggruppate così come le eventuali altre parti contraenti delle relazioni bancarie interessate sono state informate in forma anonima mediante pubblicazione nel Foglio federale (FF 2022 317), e sul sito internet dell'AFC, della ricezione di più domande raggruppate, del fatto che per ogni relazione bancaria interessata verrà emanata una decisione finale e che le persone legittimate a ricorrere hanno la possibilità di prendere posizione in merito alla prevista trasmissione all'IRS dei dati che le concernono entro 20 giorni da questa notifica (art. 12 cpv. 1 della Legge federale del 27 settembre 2013 sull'attuazione dell'Accordo FATCA tra la Svizzera e gli Stati Uniti [Legge FATCA; RS 672.933.6]). Questa notifica è stata effettuata anche per le persone legittimate a ricorrere che sono i successori legali di eventuali parti contraenti decedute delle relazioni bancarie interessate.

Le decisioni finali emanate sono notificate alle persone legittimate a ricorrere in forma anonima mediante pubblicazione sul Foglio federale e sul sito internet dall'AFC (art. 5 cpv. 3 lett. b Accordo FATCA).

L'AFC comunica quindi di aver emesso in data odierna le decisioni finali per tutte le persone che, malgrado l'avvenuta notifica, non hanno acconsentito alla procedura semplificata ai sensi dell'articolo 16 della Legge federale del 28 settembre 2012 sull'assistenza amministrativa internazionale in materia fiscale (LAAF; RS 651.1) né hanno comunicato all'AFC un indirizzo attuale svizzero oppure un rappresentante autorizzato a ricevere le notificazioni in Svizzera. L'AFC notifica queste decisioni finali mediante la presente comunicazione.

Avverso la decisione finale può essere interposto ricorso, entro 30 giorni dalla sua notifica rispettivamente dalla presente pubblicazione, presso il Tribunale amministrativo federale (art. 5 cpv. 3 lett. b Accordo FATCA in combinato disposto con l'art. 19 LAAF e gli art. 44 e segg. della legge federale del 20 dicembre 1968 sulla procedura amministrativa [PA; RS 172.021] in combinato disposto con l'art. 31 e segg. della legge federale del 17 giugno 2005 sul Tribunale amministrativo federale [LTAF; RS 173.32]). Il ricorso deve essere indirizzato a: Tribunale amministrativo federale, Corte I/Camera II, con l'indicazione: domanda raggruppata FATCA, Casella postale, 9023 San Gallo. Una copia del ricorso è da inviare a: Amministrazione federale delle contribuzioni, Servizio per lo scambio d'informazioni in materia fiscale, con l'indicazione: domanda raggruppata FATCA, Eigerstrasse 65, 3003 Berna (art. 5 cpv. 3 lett. b Accordo FATCA). Ogni decisione anteriore alla decisione finale può essere impugnata congiuntamente alla decisione finale (art. 19 cpv.

1 LAAF). L'atto di ricorso deve contenere le conclusioni, i motivi, l'indicazione dei mezzi di prova e la firma del ricorrente o del suo rappresentante.

Devono essere allegati la decisione impugnata e i mezzi di prova, se sono in possesso del ricorrente (art. 52 cpv. 1 PA). Non si applicano le disposizioni relative alla sospensione dei termini secondo l'articolo 22a capoverso 1 PA (art. 5 cpv. 2 LAAF). Il ricorso ha effetto sospensivo (art. 19 cpv. 3 LAAF).

Final decree of the Swiss Federal Tax Administration (FTA) ­ Administrative Assistance Based on Article 5 paragraph 3 letter b of the Agreement of 14 February 2013 between Switzerland and the United States of America for Cooperation to Facilitate the Implementation of FATCA (FATCA Agreement; SR 0.672.933.63), the FTA makes the following announcement: 1.

By letters dated 29 December 2021, the competent authority of the United States of America (Internal Revenue Service; hereinafter: «IRS») requests the FTA for administrative assistance based on Article 5 of the FATCA Agreement and Article 26 of the Agreement of 2 October 1996 between the Swiss Confederation and the United States of America for the Avoidance of Double Taxation with Respect to Taxes on Income (DTA CH-US; SR 0.672.933.61) as amended by the Protocol of 23 September 2009.

Information is requested concerning accounts that were identified as US accounts or as accounts of nonparticipating financial institutions to which foreign reportable amounts had been paid, which the financial institution Bank SYZ Ltd ­ in the absence of a consent to the reporting of account information ­ has reported to the IRS in aggregated form for the year 2020 pursuant to Article 3 paragraph 1 letter b (iii) and paragraph 2 letter a (ii) of the FATCA Agreement.

On 11 February 2022, the specified US persons and nonparticipating financial institutions concerned by one or more group requests as well as any other parties to the account relationships concerned were informed on an anonymous basis by a notification in the Federal Gazette (BBl 2022 317) and on the website of the FTA that several group requests have been received, that a final decree will be issued for each account relationship, and that the persons entitled to appeal may submit their opinion on the intended transmission of their data to the IRS within 20 days of this notification (Art. 12 para. 1 of the Federal Act of 27 September 2013 on the Implementation of the FATCA Agreement between Switzerland and the United States [FATCA Act; SR 672.933.6]). The same information was also given to the persons entitled to appeal who are legal successors of any deceased contracting parties to the account relationships concerned.

Final decrees are notified to the persons entitled to appeal on an anonymous basis by a publication in the Federal Gazette and on the website of the FTA (Art. 5 para. 3 let. b FATCA Agreement).

Today, the FTA has issued final decrees concerning each person who, despite notification, neither consented to the simplified procedure in accordance with Article 16 of the Federal Act of 28 September 2012 on International Administrative Assistance in Tax Matters (TAAA; SR 651.1), nor provided the FTA with a Swiss address or a person in Switzerland authorised to receive service.

The FTA notifies these final decrees with the present publication.

The final decree can be appealed to the Swiss Federal Administrative Court within 30 days of its publication respectively of the present notification (Art. 5 para. 3 let. b FATCA Agreement in connection with Art. 19 TAAA in connection with Art. 44 ff. of the Federal Act of 20 December 1968 on Administrative Procedure [APA; SR 172.021] in connection with Art. 31 ff. of the Federal Act of 17 June 2005 on the Federal Administrative Court [SR 173.32]). The appeal is to be submitted to the following address: Bundesverwaltungsgericht, Abteilung I/Kammer 2, note: FATCA group request, Postfach, 9023 St. Gallen. A copy of the appeal must be sent to the Federal Tax Administration, Service for Exchange of Information in Tax Matters, note: FATCA group request, Eigerstrasse 65, 3003 Bern (Art. 5 para. 3 let. b FATCA Agreement). Any order that was issued prior to the final decree may be contested with the final decree (Art. 19 para. 1 TAAA). The appeal must contain the claims, the grounds of the appeal including details of any evidence and be signed by the appellant or his/her representative; a copy of the contested final decree as well as any documents cited as evidence must be attached, provided they are in the appellant's possession (Art. 52 para. 1 APA).

Article 22a paragraph 1 of the APA on statutory or official periods does not apply (Art. 5 para. 2 TAAA). The appeal has suspensive effect (Art. 19 para. 3 TAAA).
