Mitteilung der Eidgenössischen Steuerverwaltung (ESTV) ­ Amtshilfe Gestützt auf Artikel 14a Absatz 6 des Bundesgesetzes vom 28. September 2012 über die internationale Amtshilfe in Steuersachen (StAhiG; SR 651.1) teilt die ESTV Folgendes mit: 1.

Mit Schreiben, eingegangen am 6. Dezember 2018, ersucht die Agenzia delle Entrate, Ufficio Cooperazione Internazionale, Italien, die ESTV um Amtshilfe gestützt auf Artikel 27 des Abkommens vom 9. März 1976 zwischen der Schweizerischen Eidgenossenschaft und der Italienischen Republik zur Vermeidung der Doppelbesteuerung und zur Regelung einiger anderer Fragen auf dem Gebiet der Steuern vom Einkommen und vom Vermögen (DBA CH-IT; SR 0.672.945.41).

Es wird um Informationen betreffend namentlich nicht bekannter natürlicher Personen ersucht, welche im Zeitraum vom 23. Februar 2015 bis zum 31. Dezember 2016 sämtliche der folgenden Kriterien erfüllen: a. Die Person war Kontoinhaber/in eines Kontos/mehrerer Konten bei der UBS Switzerland AG; b. Der/Die Kontoinhaber/in verfügte (gemäss bankinterner Dokumentation) über eine Domiziladresse in Italien; c. Die UBS Switzerland AG hat dem/der Kontoinhaber/in ein Schreiben versandt, mit welchem diese/r über die anstehende Kündigung der Geschäftsbeziehung orientiert wurde, sollte der/die Kontoinhaber/in nicht innert Frist das Formular «Tassazione dei redditi da risparmio UE ­ Autorizzazione alla divulgazione volontaria» unterzeichnet zurücksenden oder der Bank seine/ihre Steuerkonformität auf andere Art und Weise belegen; d. Der/Die Kontoinhaber/in hat der UBS Switzerland AG trotz Versand des vorgenannten Schreibens keinen der Bank genügenden Nachweis über die Steuerkonformität erbracht.

Von der Übermittlung ausgenommen sind Konten: a. die gestützt auf das Zinsbesteuerungsabkommen CH-EU offengelegt wurden; oder b. die im Rahmen des automatischen Informationsaustauschs zwischen der Schweiz und Italien offengelegt wurden; oder c. für die der/die Kontoinhaber/in der UBS Switzerland AG eine Ermächtigung zu deren Offenlegung im Rahmen des italienischen Programms zur freiwilligen Offenlegung (sog. Voluntary Disclosure Program (VDP)) erteilt hat; oder

deren Gesamtbetrag im Rahmen eines italienischen «scudo fiscale» regularisiert wurde und welche die folgenden Voraussetzungen kumulativ erfüllen (sog. «juridical repatriation»): ­ der Gesamtbetrag der Konten zum Zeitpunkt der Unterzeichnung der anonymen Erklärung entsprach der Höhe der in der anonymen Erklärung angegebenen regularisierten Vermögenswerte; und ­ die anonyme Erklärung wurde vom Steuerpflichtigen unterzeichnet und durch ein Finanzinstitut mit Sitz in Italien gegengezeichnet sowie mit einem Stempel versehen; und ­ nach der Unterzeichnung der anonymen Erklärung wurde kein neues Geld auf das Konto transferiert. Die Erträge aus den regularisierten Vermögenswerten gelten nicht als Neugeld; und ­ das an das italienische Finanzinstitut erteilte Mandat, als für die Quellensteuer zuständige Stelle («withholding agent») und meldender Finanzintermediär («reporting intermediary») zu agieren, wurde nicht widerrufen, es sei denn, ein anderes Mandat an ein anderes italienisches Finanzinstitut wurde erteilt und dieses Mandat umfasste die Delegation, die Quellensteuer- und Meldepflichten vis-à-vis den italienischen Steuerbehörden wahrzunehmen; oder für die der/die Kontoinhaber/in den Beweis erbracht hat, dass die Vermögenswerte auf dem Konto/den Konten am Ende des letzten Steuerjahres, für welches die Frist für die Einreichung der Steuererklärung abgelaufen ist, in der entsprechenden und ordnungsgemäss bei der italienischen Steuerbehörde eingereichten Steuererklärung aufgenommen wurden, genauer im RW-Formular. Wenn der Betrag, der als bei Schweizerischen Finanzinstituten gehalten deklariert wurde, höher ist als der Kontosaldo des betreffenden Kontos/der betreffenden Konten am Ende des letzten Steuerjahres, muss der/die Kontoinhaber/in der ESTV den Kontoauszug/die Kontoauszüge betreffend der übrigen Vermögenswerte bei schweizerischen Finanzinstituten vorlegen, damit die ESTV prüfen kann, ob die ausgewiesenen Vermögenswerte den Kontoguthaben entsprechen. Wenn der als bei schweizerischen Finanzinstituten gehalten deklarierte Betrag niedriger ist als der Kontostand des betreffenden Kontos/der betreffenden Konten am Ende des letzten Steuerjahres, entfällt die in diesem litera e) vorgesehene Befreiung von der Mitteilung des Kontos; oder für die die angeforderten Informationen bereits in einem früheren Amtshilfeverfahren an die zuständige italienische Behörde übermittelt wurden.

Mit Datum vom 6. August 2019 (BBl 2019 5431) wurden gestützt auf Artikel 14a Absatz 4 StAhiG die vom italienischen Amtshilfeersuchen betroffenen Personen ohne Namensnennung durch Publikation im Bundesblatt (a) über den Eingang und den Inhalt des Ersuchens, (b) über ihre Pflicht, der ESTV ihre Schweizer Adresse anzugeben, sofern sie ihren Sitz oder Wohnsitz in der Schweiz haben, oder eine zur Zustellung bevollmächtigte Person in der Schweiz zu bezeichnen, sofern sie ihren Wohnsitz im Ausland haben, 5839

(c) über das vereinfachte Verfahren nach Artikel 16 StAhiG, und (d) darüber informiert, dass eine Schlussverfügung für jede betroffene bzw. beschwerdeberechtigte Person erlassen wird, sofern diese nicht dem vereinfachten Verfahren zugestimmt hat. Diese Information erfolgte auch für jene beschwerdeberechtigten Personen, die Mitinhaber/innen eines unter Ziffer 1 fallenden Kontos sind, jedoch keine Domiziladresse in Italien aufweisen.

Kann die ESTV eine Schlussverfügung den betroffenen und/oder beschwerdeberechtigten Personen nicht zustellen, so notifiziert sie diesen die Verfügung gemäss Artikel 14a Absatz 6 StAhiG ohne Namensnennung durch Mitteilung im Bundesblatt.

Demgemäss teilt die ESTV mit: Mit heutigem Datum hat die ESTV eine Schlussverfügungen betreffend all jener Personen erlassen, die trotz erfolgter Notifikation weder dem vereinfachten Verfahren nach Artikel 16 StAhiG zugestimmt noch der ESTV eine Schweizer Adresse oder eine zur Zustellung bevollmächtigte Person in der Schweiz bezeichnet haben.

Gegen die entsprechende Schlussverfügung kann innert 30 Tagen nach Eröffnung bzw. vorliegender Mitteilung beim Bundesverwaltungsgericht Beschwerde geführt werden (Art. 19 StAhiG i.V.m. Art. 44 ff. des Bundesgesetzes vom 20. Dezember 1968 über das Verwaltungsverfahren (VwVG; SR 172.021) i.V.m. Artikel 31 ff. des Bundesgesetzes vom 17. Juni 2005 über das Bundesverwaltungsgericht (VGG; SR 173.32)). Die Beschwerde ist an folgende Adresse zu richten: Bundesverwaltungsgericht, Abteilung I/Kammer 2, Gruppenersuchen, Postfach, 9023 St. Gallen. Jede der Schlussverfügung vorangehende Verfügung kann zusammen mit der Schlussverfügung angefochten werden (Art. 19 Abs. 1 StAhiG). Die Beschwerdeschrift hat die Begehren, deren Begründung mit Angabe der Beweismittel und die Unterschrift der beschwerdeführenden Person oder ihrer Vertretung zu enthalten. Die angefochtene Verfügung und die Beweismittel sind, soweit sie die beschwerdeführende Partei in Händen hat, beizulegen (Art. 52 Abs. 1 VwVG). Die Bestimmungen über den Stillstand der Fristen gemäss Artikel 22a Absatz 1 VwVG sind nicht anwendbar (Art. 5 Abs. 2 StAhiG). Die Beschwerde hat aufschiebende Wirkung (Art. 19 Abs. 3 StAhiG).

Die Beschwerdefrist beginnt am Tag nach der Notifikation im Bundesblatt zu laufen (Art. 14a Abs. 6 StAhiG).

Die begründete Schlussverfügung kann bei der Eidgenössischen Steuerverwaltung, Eigerstrasse 65, 3003 Bern, eingesehen werden.

Notice from the Federal Tax Administration (FTA) ­ administrative assistance Based on Art. 14a para. 6 of the Federal Act of 28 September 2012 on International Administrative Assistance in Tax Matters (TAAA, SR 651.1) the FTA makes the following announcement: 1.

By letter received on 6 December 2018 the Agenzia delle Entrate, Ufficio Cooperazione Internazionale, Italy, requests the FTA for administrative assistance based on Art. 27 of the Convention of 9 March 1976 between the Swiss Confederation and the Italian Republic for the Avoidance of Double Taxation with Respect to Taxes on Income and on Capital (DTA CH-IT; SR 0.672.945.41).

Information is requested concerning natural persons, whose names are unknown and who fulfil all of the following criteria during the time period from 23 February 2015 to 31 December 2016: a. The person was an account holder of (an) account(s) with UBS Switzerland AG; b. The account holder had his/her domicile address in Italy (according to the bank documentation of UBS Switzerland AG); c. The account holder was sent a letter in which UBS Switzerland AG announced the forced closure of the bank account(s) unless he/she provided the bank with the signed form «Tassazione dei redditi da risparmio UE ­ Autorizzazione alla divulgazione volontaria» or other proof of his/her tax compliance with regard to the account(s).

d. Despite this letter the account holder did not provide UBS Switzerland AG with sufficient evidence of his/her tax compliance with regard to the account(s).

Exempt are the accounts: a. which have been disclosed within the framework of the Agreement on the Taxation of Savings between the Swiss Confederation and the European Union; or b. which have been disclosed within the framework of the automatic exchange of information on financial accounts between Switzerland and Italy; or c. for which an authorization regarding the specific account(s) has been provided to UBS Switzerland AG within the framework of the Italian Voluntary Disclosure Program (VDP); or d. for which the overall amount of the account(s) of the Italian taxpayer held with UBS Switzerland AG has been regularized within the framework of an Italian «scudo fiscale» and the account(s) fulfil(s) all of the following conditions (so called «juridical repatriation»):

the overall amount of the account(s) held with UBS Switzerland AG at the time of the signature of the anonymous declaration was equivalent to the amount of the Swiss regularized assets indicated on the anonymous declaration; and ­ the anonymous declaration was signed by the taxpayer and countersigned as well as stamped by a financial institution located in ltaly; and ­ no new money was deposited into the account(s) after the date of signature of the anonymous declaration. Proceeds of regularized assets do not qualify as new money; and ­ the Italian financial institution mandate to act as a withholding agent and a reporting intermediary has not been revoked, unless another mandate to a different Italian financial institution was given and that mandate includes a delegation to perform withholding tax and reporting obligations to the Italian tax authorities; or for which the taxpayer has provided evidence to the Swiss Federal Tax Administration that the assets in the account(s) at the end of the last tax year for which the deadline to hand in the tax return has passed were included in the appropriate tax return duly filed with the Italian tax administration, more specifically in the RW-form. lf the amount declared, as held with Swiss financial institutions, is higher than the account balance at the end of the last tax year of the concerned account(s), the taxpayer has to submit to the Swiss Federal Tax Administration the account statement(s) regarding the other assets with Swiss financial institutions in order to enable the Swiss Federal Tax Administration to examine if the assets declared are equivalent to the account balances. If the amount declared as held with Swiss financial institutions is lower than the account balance at the end of the last tax year of the concerned account(s), the exemption from the communication of the account provided for in this letter e) does not apply; or for which the requested information has already been transmitted to the Italian Competent Authority in a prior administrative assistance procedure.

By publication dated 6 August 2019 (BBl 2019 5431) the persons concerned by the Italian request for administrative assistance were informed anonymously based on Art. 14a para. 4 TAAA (a) about the receipt and content of the request, (b) about the obligation to give the FTA their address in Switzerland if they are resident or domiciled in Switzerland or to designate a person authorized to receive service in Switzerland if they are resident or domiciled abroad, (c) about the simplified procedure in accordance with Art. 16 TAAA, and (d) that a final decree will be issued for each person entitled to appeal who has not consented to the simplified procedure. The same information was also given to the persons entitled to appeal, who are co-owners of an account covered by para. 1, but do not have a domicile address in Italy.

If the FTA is unable to deliver a final decree to persons concerned and/or persons entitled to appeal, it shall notify them of such a decree anonymously via a publication in the Federal Gazette in accordance with Art. 14a para. 6 TAAA.

Accordingly, the FTA informs: Today the FTA has issued a final decree concerning each person who, despite notification, neither consented to the simplified procedure according to Art. 16 TAAA, nor provided the FTA with his/her address in Switzerland or designated a person authorized to receive service in Switzerland.

The corresponding final decree can be appealed to the Swiss Federal Administrative Court within 30 days of its opening respectively of the present notification (Art. 19 TAAA in connection with Art. 44 ff. of the Federal Act of 20 December 1968 on Administrative Procedure (APA; SR 172.021) in connection with Art. 31 ff. of the Federal Act of 17 June 2005 on the Federal Administrative Court (SR 173.32])). The appeal is to be submitted to the following address: Bundesverwaltungsgericht, Abteilung I/Kammer 2, Gruppenersuchen, Postfach, 9023 St. Gallen. Any order that was issued prior to the final decree may be contested with the final decree (Art. 19 para. 1 TAAA). The appeal must contain the claims, the grounds of the appeal including details of any evidence and be signed by the appellant or his/her representative; a copy of the contested final decree as well as any documents cited as evidence must be attached, provided they are in the appellant's possession (Art. 52 para. 1 APA). Art. 22a para. 1 of the APA on Statutory or Official Periods does not apply (Art. 5 para. 2 TAAA). The appeal has suspensive effect (Art. 19 para. 3 TAAA).

The appeal period starts running on the day following this notification in the Federal Gazette (Art. 14a para. 6 TAAA).

The issued final decree can be reviewed at the Federal Tax Administration at the following address: Eigerstrasse 65, 3003 Bern.
