Décision portant modification de la structure de l'espace aérien suisse en 2019 du 6 mars 2019

Objet:
La structure de l'espace aérien suisse tel qu'il est représenté sur la carte aéronautique OACI Suisse 2018 est modifiée comme suit.
Base légale:
Conformément aux art. 8a et 40 de la loi du 21 décembre 1948 sur l'aviation (LA; RS 748.0) en relation avec l'art. 2, al. 1 de l'ordonnance du 18 décembre 1995 sur le service de la navigation aérienne (OSNA; RS 748.132.1), l'OFAC établit la structure de l'espace aérien et les classes d'espace aérien après avoir entendu les Forces aériennes et Skyguide. En établissant la structure de l'espace aérien, l'autorité définit les conditions d'utilisation des différentes portions de l'espace aérien suisse et les droits et obligations en matière de services de navigation aérienne qui y sont associés. L'OFAC réexamine la structure de l'espace aérien tous les ans. La modification de la structure de l'espace aérien suisse en 2019 se base sur la carte aéronautique OACI de la Suisse 2018.
Conformément à l'art. 8a, al. 2, LA, les recours formés contre les décisions de l'OFAC établissant la structure de l'espace aérien n'ont aucun effet suspensif.
Teneur de la décision:
1. La TMA 4 Alpnach est réduite; ses nouvelles dimensions verticales et horizontales figurent à l'annexe 1 de la présente décision.
2. Les zones réglementées pour planeurs établies par voie de décision le 1er février 2012 sont modifiées comme suit:

La zone LS-R44A OBERALP est intégrée dans la zone LSR44 OBERALP
La portion d'espace aérien de la zone LSR44 OBERALP correspondant à l'ancienne zone LS-R44A OBERALP (limite supérieure: FL 130) est active en période MIL OFF
Les conditions et dimensions générales de ces zones réglementées restent inchangées.
Les dimensions horizontales et verticales de ces zones figurent à l'annexe 1 de la présente décision.
3. Les espaces aériens réservés à la pratique du vol à voile «LS-T for gliders» sont reclassés zones réglementées pour planeurs «LS-R for gliders». Quand les zones réglementées sont activées, l'espace aérien C (classe d'espace aérien de la TMA) devient un espace aérien de classe E. Les conditions et dimensions générales existantes de ces zones réglementées restent inchangées. Les dimensions horizontales et verticales de ces zones figurent à l'annexe 1 de la présente décision.
Le code figurant dans la désignation des zones passe de «LS-T» à «LSR». Un «T» est adjoint à la désignation des zones LSR afin de garantir un renvoi aux exzones LS-T.
4. La modification de la structure de l'espace aérien suisse visée aux ch. 1 à 3 ci-dessus (ch. 1 du dispositif de la décision du 6 mars 2019) entre en vigueur le 28 mars 2019. La présente décision s'applique pour une durée indéterminée et est valable jusqu'à sa révocation ou jusqu'à ce qu'une modification ultérieure concerne les structures établies en vertu de la présente décision.
5. La Publication d'information aéronautique (AIP) sera temporairement adaptée et les indications temporelles qu'elle contient seront modifiées étant entendu que 2258

ces adaptations et modifications font partie intégrante de la présente décision.
6. La présente décision est notifiée sous pli recommandé aux Forces aériennes et à Skyguide et communiquée sous pli ordinaire aux membres du National Air Management Advisory Committee (NAMAC). Elle est également publiée dans la Feuille fédérale en français, en allemand et en italien.

7. Vu son intérêt public, la présente décision ne donne lieu à aucun frais conformément à l'art. 5, al. 3, de l'ordonnance sur les émoluments de l'Office fédéral de l'aviation civile (OEmol-OFAC; RS 748.112.11).

La présente modification de la structure de l'espace aérien suisse 2019 intéresse toutes les personnes qui utilisent d'une manière ou d'une autre l'espace aérien en question ou qui exercent des activités susceptibles d'avoir des incidences sur cet espace et donc sur la sécurité du trafic aérien.
Enquête publique:
La présente décision est publiée dans la Feuille fédérale en allemand, en français et en italien. Elle peut également être obtenue auprès de l'OFAC, division Sécurité des infrastructures en téléphonant au 058 467 40 53.
Voies de droit:
Un recours peut être formé dans les 30 jours contre la présente décision auprès du Tribunal administratif fédéral, case postale, 9023 Saint-Gall. Le mémoire de recours envoyé en double exemplaire, indiquera les conclusions, les motifs et les moyens de preuve et devra porter la signature du recourant. La décision attaquée et, dans la mesure du possible, les pièces invoquées comme moyen de preuve, de même qu'une procuration en cas de représentation seront jointes au recours.
