Communication de l'Administration fédérale des contributions (AFC) ­ Assistance administrative En vertu de l'art. 14a al. 4 de la loi fédérale du 28 septembre 2012 sur l'assistance administrative internationale en matière fiscale (LAAF; RS 651.1), l'AFC communique ce qui suit: 1.

Par courrier du 23 novembre 2018, l'Agenzia delle Entrate, Ufficio Cooperazione Internazionale, Italie, a adressé à l'AFC une demande d'assistance administrative selon l'art. 27 de la Convention du 9 mars 1976 entre la Confédération suisse et la République italienne en vue d'éviter les doubles impositions et de régler certaines autres questions en matière d'impôts sur le revenu et sur la fortune (CDI CH-IT, RS 0.672.945.41).

Il est demandé de fournir des informations concernant des personnes physiques dont le nom n'est pas connu et qui, durant la période du 23 février 2015 au 31 décembre 2016, remplissent tous les critères suivants: a. La personne concernée était titulaire d'un ou de plusieurs comptes auprès de la banque BSI SA, ou par la suite auprès de la banque EGF AG; b. Le/la titulaire du compte disposait (selon la documentation bancaire interne de la banque BSI SA respectivement EFG AG) d'une adresse de domicile en Italie; c. La banque BSI SA a envoyé au/à la titulaire du compte un courrier déclarant que les prestations bancaires seraient réduites si le/la titulaire du compte ne démontrait pas sa conformité fiscale; d. Malgré l'envoi de ce courrier, le/la titulaire du compte n'a pas fourni de preuve suffisante de sa conformité fiscale à la banque BSI SA, respectivement EFG AG, ni avant ni après l'envoi de ce courrier.

Sont exclus de la transmission, les comptes: a. qui ont été divulgués sur la base de l'accord sur la fiscalité de l'épargne CH-EU; ou b. qui ont été divulgués dans le cadre de l'échange automatique d'informations entre la Suisse et l'Italie; ou c. que le/la titulaire a autorisé la banque BSI SA, respectivement EFG AG, à divulguer dans le cadre du programme italien de déclaration volontaire (Voluntary Disclosure Programm [VDP]); ou d. dont le montant total a été régularisé dans le cadre d'un «scudo fiscale» italien et qui remplissent cumulativement les conditions suivantes («juridical repatriation»): ­ le montant total figurant sur les comptes au moment de la signature de la déclaration anonyme correspondait au montant des avoirs régularisés déclarés dans la déclaration anonyme; et

la déclaration anonyme a été signée par le contribuable ainsi que contresignée et estampillée par une institution financière sise en Italie; et ­ aucun nouvel avoir n'a été transféré sur le compte après la signature de la déclaration anonyme, étant entendu que les revenus des avoirs régularisés ne sont pas considérés comme de nouveaux avoirs; et ­ le mandat donné à l'institution financière italienne d'agir en tant qu'agent de retenue à la source («withholding agent») et d'intermédiaire financier («reporting intermediary») n'a pas été révoqué, à moins qu'un autre mandat n'ait été donné à une autre institution financière italienne et que ce mandat ne comporte une délégation pour effectuer la retenue à la source et les obligations de déclaration vis-à-vis des autorités fiscales italiennes; ou pour lesquels le/la titulaire a apporté la preuve que les actifs figurant sur le/s compte/s concerné/s à la fin de la dernière année fiscale pour laquelle le délai de dépôt la déclaration fiscale est écoulé, ont été déclarés dans la déclaration fiscale correspondante dûment déposée auprès des autorités fiscales italiennes, plus précisément dans le formulaire RW. Si le montant déclaré comme étant détenu auprès d'instituts financiers suisses est supérieur au solde du/des compte/s concerné/s à la fin de la dernière année fiscale, le/la titulaire doit soumettre à l'AFC les relevés bancaires relatifs aux autres actifs détenus auprès d'instituts financiers suisses, afin de permettre à l'AFC de vérifier si les actifs affichés correspondent aux soldes bancaires. Si le montant déclaré comme étant détenu auprès d'instituts financiers suisses est inférieur au solde du/des compte/s concerné/s à la fin de la dernière année fiscale, l'exemption prévue à la présente lettre e) n'est pas applicable; pour lesquels les informations requises ont déjà été transmises aux autorités compétentes italiennes dans le cadre d'une procédure d'assistance administrative précédente.

Les personnes concernées par la demande d'assistance doivent communiquer à l'AFC leur adresse actuelle en Suisse dans la mesure où elles sont domiciliées en Suisse, ou désigner un représentant en Suisse autorisé à recevoir des notifications, si elles sont domiciliées à l'étranger. Le délai accordé pour indiquer une adresse en Suisse ou pour désigner le représentant autorisé à recevoir des notifications est de 20 jours et commence à courir le lendemain de la publication dans la Feuille fédérale.

L'AFC précise que les personnes qui sont co-titulaires d'un compte visé sous le ch. 1 mais qui ne sont pas domiciliées en Italie, ainsi que les successeurs en droit de tout/e titulaire décédé/e d'un compte visé sous le ch. 1, peuvent participer à la procédure en tant que personnes habilitées à recourir.

En cas de participation, ces personnes sont également tenues, dans un délai de 20 jours à compter du jour qui suit la publication dans la Feuille fédérale, de communiquer une adresse en Suisse, si elles sont domiciliées en Suisse,

ou de désigner un représentant en Suisse autorisé à recevoir des notifications, si elles sont domiciliées à l'étranger.

Le nom et l'adresse de la personne autorisée à recevoir des notifications en Suisse, respectivement l'adresse actuelle en Suisse doivent être communiqués à l'AFC par e-mail, à administrative.assistance@estv.admin.ch, ou à l'adresse suivante: Administration fédérale des contributions AFC Eigerstrasse 65 CH-3003 Berne La possibilité prévue à l'art. 14a al. 4 let. b ch. 2 LAAF d'indiquer à l'AFC une adresse à l'étranger, pour autant que la notification par voie postale de documents à destination du pays concerné soit admise, n'est pas applicable dans le cas présent, au vu du champ d'application temporel de la Convention concernant l'assistance administrative mutuelle en matière fiscale du 25 janvier 1988, telle qu'amendée par le Protocole du 27 mai 2010 (RS 0.652.1).

Les personnes concernées/habilitées à recourir peuvent prendre part à la procédure simplifiée conformément à l'art. 16 LAAF et consentir à la remise des renseignements à l'autorité requérante en informant l'AFC par écrit. Le consentement est irrévocable. L'AFC clôt la procédure en transmettant les renseignements à l'autorité requérante et lui signifie le consentement des personnes concernées/habilitées à recourir.

A défaut de consentement à la procédure simplifiée, l'AFC rendra une décision finale susceptible de recours conformément à l'art. 17 LAAF. Si l'AFC ne peut pas remettre une décision finale aux personnes concernées/habilitées à recourir, elle la leur notifie dans la Feuille fédérale sans indiquer de nom (art. 14a al. 6 LAAF).

Notification from the Federal Tax Administration (FTA) ­ administrative assistance Based on Art. 14a para. 4 of the Federal Act of 28 September 2012 on International Administrative Assistance in Tax Matters (TAAA; SR 651.1) the FTA makes the following announcement: 1.

By letter dated 23 November 2018 the Agenzia delle Entrate, Ufficio Cooperazione Internazionale, Italy, requests the FTA for administrative assistance based on Art. 27 of the Convention of 9 March 1976 between the Swiss Confederation and the Italian Republic for the Avoidance of Double Taxation with Respect to Taxes on Income and on Capital (DTA CH-IT; SR 0.672.945.41).

Information is requested concerning natural persons, whose names are unknown and who fulfil all of the following criteria during the time period from 23 February 2015 to 31 December 2016: a. The person concerned was an account holder of (an) account(s) with BSI SA or subsequently with EFG AG; b. The account holder had his/her domicile address in Italy (according to the internal bank documentation); c. The account holder was sent a letter in which BSI SA informed about restrictions on banking services unless the account holder had provided the bank with proof of his/her tax compliance; d. Despite this letter the account holder did not provide BSI SA or EFG AG ­ neither before nor after this letter ­ with sufficient evidence of his/her tax compliance with regard to the account(s).

Exempt are the accounts: a. which have been disclosed within the framework of the Agreement on the Taxation of Savings between the Swiss Confederation and the European Union; or b. which have been disclosed within the framework of the automatic exchange of information on financial accounts between Switzerland and Italy; or c. for which an authorization regarding the specific account(s) has been provided to BSI SA or EFG AG within the framework of the Italian Voluntary Disclosure Program (VDP); or d. for which the overall amount of the account(s) of the Italian taxpayer held with BSI SA or EFG AG has been regularized within the framework of an Italian «scudo fiscale» and the account(s) fulfil(s) all of the following conditions (so called «juridical repatriation»): ­ the overall amount of the account(s) maintained with BSI SA or EFG AG at the time of the signature of the anonymous declaration was equivalent to the amount of the Swiss regularized assets indicated on the anonymous declaration; and

the anonymous declaration has been signed by the taxpayer and countersigned as well as stamped by a financial institution located in ltaly; and ­ no new money was deposited into the account(s) after the date of signature of the anonymous declaration. Proceeds of regularized assets do not qualify as new money; and ­ the mandate to the Italian financial institution to act as withholding agent and reporting intermediary has not been revoked, unless another mandate to another Italian financial institution has been given and such a mandate includes a delegation to perform withholding tax and reporting obligations to the Italian tax authorities; or for which the taxpayer has provided evidence to the Swiss Federal Tax Administration that the assets in the account(s) at the end of the last tax year for which the deadline to hand in the tax return has passed were included in the appropriate tax return duly filed with the Italian tax administration, more specifically in the RW-form. lf the amount declared as held with Swiss financial institutions is higher than the account balance at the end of the last tax year of the concerned account(s), the taxpayer has to submit to the Swiss Federal Tax Administration the account statement(s) regarding the other assets with Swiss financial institutions in order to enable the Swiss Federal Tax Administration to examine if the assets declared are equivalent to the account balances. If the amount declared as held with Swiss financial institutions is lower than the account balance at the end of the last tax year of the concerned account(s), the exemption from the communication of the account provided for in this letter e) does not apply; or for which the requested information has already been transmitted to the Italian Competent Authority in a prior administrative assistance procedure.

The persons concerned by the request for administrative assistance are requested to provide the FTA with their Swiss address, provided they are domiciled in Switzerland, or to designate a representative to receive service in Switzerland, provided they are domiciled abroad. The deadline within which the Swiss address or the representative to receive service in Switzerland has to be named is 20 days; the deadline starts running on the day following the publication in the Federal Gazette.

The FTA draws attention to the fact that persons who own an account mentioned under para. 1 jointly, however, do not have a domicile address in Italy, or the legal heirs of any possible deceased holder of an account mentioned under para. 1, can take part in the procedure as a person entitled to appeal. If such a participation is intended, then these persons are also requested to provide the FTA with the details of their current address in Switzerland if they are resident in Switzerland, or with the details of a representative to receive service in Switzerland, if they are resident abroad, within the time period of 20 days.

The name and address of the representative to receive service in Switzerland, respectively the current Swiss address is to be communicated to the FTA either via email to administrative.assistance@estv.admin.ch or via the following address: Federal Tax Administration FTA Eigerstrasse 65 CH-3003 Bern The possibility in accordance with Art. 14a para. 4 letter b subpara. 2 TAAA to provide the FTA with a foreign address, provided it is permitted to serve documents in the state concerned by post, is ­ with regard to the time period applicable under the Agreement dated 25 January 1988, amended through the Protocol dated 27 Mai 2010 on the mutual administrative assistance in tax matters (SR 0.652.1) ­ not applicable.

According to Art. 16 TAAA the person concerned/person entitled to appeal has the possibility to participate in the simplified procedure. If the person concerned/person entitled to appeal consents to the transmission of the information to the requesting authority, he/she shall inform the FTA of this.

This consent is irrevocable. The FTA closes the procedure by transmitting the information to the requesting authority with reference being made to the consent given by the person concerned/person entitled to appeal.

If the person concerned/person entitled to appeal does not consent to the simplified procedure the FTA will issue a final decree in accordance with Art. 17 TAAA. If the final decree cannot be delivered to the person concerned/person entitled to appeal the FTA will notify the person concerned/person entitled to appeal about the final decree through an anonymous publication in the Federal Gazette (Art. 14a para. 6 TAAA).
