Communication de l'Administration fédérale des contributions (AFC) ­ Assistance administrative En vertu de l'art. 14a, al. 6, de la loi du 28 septembre 2012 sur l'assistance administrative fiscale (LAAF; RS 651.1), l'AFC communique ce qui suit: 1.

Par courrier du 19 mars 2019, le Ministry of Finance, Israel Tax Authority, International Tax Division (ci-après: «Israel Tax Authority»), a adressé à l'AFC une demande d'assistance administrative selon l'art. 5 de la Convention du 25 janvier 1988 concernant l'assistance administrative mutuelle en matière fiscale (Convention on Mutual Administrative Assistance in Tax Matters, MAC; RS 0.652.1).

Il est demandé de fournir des informations concernant des personnes physiques dont le nom n'est pas connu et qui, durant la période du 1 janvier 2014 au 31 décembre 2017, remplissent tous les critères suivants: a. La personne concernée était titulaire d'un/de plusieurs compte/s auprès de l'UNION BANCAIRE PRIVEE, UBP SA; b. Le/la titulaire du compte disposait (selon la documentation bancaire interne de l'UNION BANCAIRE PRIVEE, UBP SA) d'une adresse de domicile en Israël; c. L'UNION BANCAIRE PRIVEE, UBP SA a envoyé au/à la titulaire du compte un courrier par lequel elle a requis celui-ci/celle-ci de fournir la preuve de sa conformité fiscale avec le formulaire «Statement of tax compliance», à défaut de laquelle la relation d'affaires devra être terminée; d. Malgré l'envoi de ce courrier, le/la titulaire du compte n'a pas fourni de preuve suffisante à l'UNION BANCAIRE PRIVEE, UBP SA de sa conformité fiscale.

Sont exclus de la transmission, les comptes: a. pour lesquels le/la titulaire du compte a apporté l'une des preuves suivantes: ­ preuve que le/la titulaire du compte était exonéré/e d'impôt respectivement n'avait pas d'obligation déclarative pour le/les compte/s en vertu d'un «pre-ruling» relatif à son immigration en Israël («Aliyah»); ou ­ preuve d'une déclaration fiscale effective du/des compte/s en Israël; ou ­ preuve que le/la titulaire du compte a déclaré le/les compte/s dans le cadre du programme israélien de déclaration volontaire (dénommé Voluntary Disclosure Programm [VDP]);

b.

au sujet desquels des informations ont déjà été transmises aux autorités compétentes israéliennes dans le cadre d'une procédure d'assistance administrative précédente.

En date du 25 juin 2019 (FF 2019 4211), conformément à l'art. 14a, al. 4, LAAF, les personnes concernées par la demande d'assistance administrative israélienne ont été informées, par publication anonyme dans la Feuille fédérale, (a) de la réception et du contenu de la demande, (b) de leur devoir d'indiquer à l'AFC leur adresse actuelle en Israël ou Suisse dans la mesure où elles sont domiciliées en Israël ou en Suisse ou de désigner à l'AFC un représentant en Suisse autorisé à recevoir des notifications, si elles sont domiciliées à l'étranger, hors d'Israël, (c) de la procédure simplifiée fixée à l'art. 16 LAAF, et (d) qu'une décision finale sera établie pour chaque personne concernée, respectivement habilitée à recourir, dans la mesure où la personne n'a pas consenti à la procédure simplifiée. Cette information concernait également les personnes habilitées à recourir co-titulaires d'un compte défini sous le ch. 1, mais qui ne présentaient pas d'adresse de domicile en Israël.

Si l'AFC ne peut pas remettre une décision finale aux personnes concernées et/ou personnes habilitées à recourir, elle la leur notifie en la publiant dans la Feuille fédérale sans indiquer de nom, conformément à l'art. 14a, al. 6, LAAF.

En conséquence, l'AFC communique ce qui suit: A la date de ce jour, l'AFC a établi une décision finale concernant chaque personne qui, malgré la notification, n'a ni consenti à la procédure simplifiée au sens de l'art. 16 LAAF, ni communiqué à l'AFC une adresse israélienne ou Suisse ou désigné un représentant en Suisse autorisé à recevoir des notifications.

Un recours peut être interjeté contre la décision finale correspondante, auprès du Tribunal administratif fédéral dans le délai de 30 jours suivant sa notification, respectivement la présente publication dans la Feuille fédérale (art. 19 LAAF en relation avec les art. 44 ss de la loi fédérale du 20 décembre 1968 sur la procédure administrative [PA; RS 172.021] et les art. 31 ss de la loi du 17 juin 2005 sur le Tribunal administratif fédéral [RS 173.32]). Le recours est à envoyer à l'adresse suivante: Tribunal administratif fédéral, Cour I/Chambre 2, Demande groupée, Case postale, 9023 Saint-Gall. Toute décision précédant la décision finale peut faire l'objet d'un recours avec la décision finale (art. 19, al. 1, LAAF). Le mémoire de recours doit contenir les conclusions, les motifs avec indication des moyens de preuve et la signature de la partie recourante ou de son mandataire. La décision attaquée et les pièces invoquées comme moyens de preuve doivent être jointes, dans la mesure où la partie recourante les possède (art. 52, al. 1, PA). Les dispositions relatives aux féries au sens de l'art. 22a, al. 1, PA ne sont pas applicables (art. 5, al. 2, LAAF). Le recours a effet suspensif (art. 19, al. 3, LAAF).

Le délai de recours court à compter du jour qui suit la notification dans la Feuille fédérale (art. 14a, al. 6, LAAF).

Notice from the Federal Tax Administration (FTA) ­ administrative assistance Based on Art. 14a para. 6 of the Federal Act of 28 September 2012 on International Administrative Assistance in Tax Matters (TAAA, SR 651.1) the FTA makes the following announcement: 1.

By letter dated 19 March 2019 the Ministry of Finance, Israel Tax Authority, International Tax Division (in the following: «Israel Tax Authority»), requests the FTA for administrative assistance based on Art. 5 of the Multilateral Convention dated 25 January 1988 on Mutual Administrative Assistance in Tax Matters (MAC; SR 0.652.1).

Information is requested concerning natural persons, whose names are unknown and who fulfil all of the following criteria during the time period from 1 January 2014 to 31 December 2017: a. The person was an account holder of (an) account(s) with UNITED PRIVATE BANK, UBP LTD; b. The account holder had a domicile address in Israel (according to the bank documentation of UNITED PRIVATE BANK, UBP LTD); c. The account holder was sent a letter in which UNITED PRIVATE BANK, UBP LTD requested the account holder to provide the bank within the set deadline with the form «Statement of tax compliance», otherwise the business relationship would need to be terminated; d. Despite of this letter the account holder did not provide UNITED PRIVATE BANK, UBP LTD with sufficient evidence of his/her tax compliance with regard to the account(s).

Exempt are the accounts: a. for which the account holder provided one of the following: ­ evidence that the account holder was tax-exempt and not subject to declaration for the account(s) in accordance with a «pre-ruling» in connection with his/her immigration to Israel («Aliyah»); or ­ evidence of a filed tax return declaring the account(s) in Israel; or ­ evidence that the account holder declared the account(s) within the Israeli Voluntary Disclosure Program (VDP); b. for which information has already been transmitted to the Israel Tax Authority in a previous administrative assistance procedure.

By publication dated 25 June 2019 (BBl 2019 4211) the persons concerned by the Israeli request for administrative assistance were informed anonymously based on Art. 14a para. 4 TAAA (a) about the receipt and content of the request, (b) about the obligation to give the FTA their Israeli or Swiss address, if they are resident or domiciled in Israel or Switzerland, or to designate a person authorized to receive service in Switzerland, if they are resident or domiciled abroad (outside of Israel), (c) about the simplified procedure in accordance with Art. 16 TAAA, and (d) that a final decree will be

issued for each person concerned respectively entitled to appeal who has not consented to the simplified procedure. The same information was also given to the persons entitled to appeal, who are co-owners of an account covered by para. 1, but do not have a domicile address in Israel.

If the FTA is unable to deliver a final decree to persons concerned and/or persons entitled to appeal, it shall notify them of such decree anonymously via a publication in the Federal Gazette in accordance with Art. 14a para. 6 TAAA.

Accordingly, the FTA informs: Today the FTA has issued a final decree concerning each person who, despite notification, neither consented to the simplified procedure according to Art. 16 TAAA, nor provided the FTA with his/her address in Israel or Switzerland or designated a person authorized to receive service in Switzerland.

The corresponding final decree can be appealed to the Swiss Federal Administrative Court within 30 days of its opening respectively of the present notification (Art. 19 TAAA in connection with Art. 44 ff. of the Federal Act of 20 December 1968 on Administrative Procedure [APA; SR 172.021] in connection with Art. 31 ff. of the Federal Act of 17 June 2005 on the Federal Administrative Court [SR 173.32]). The appeal is to be submitted to the following address: Bundesverwaltungsgericht, Abteilung I/Kammer 2, Gruppenersuchen, Postfach, 9023 St. Gallen. Any order that was issued prior to the final decree may be contested with the final decree (Art. 19 para. 1 TAAA). The appeal must contain the claims, the grounds of the appeal including details of any evidence and be signed by the appellant or his/her representative; a copy of the contested final decree as well as any documents cited as evidence must be attached, provided they are in the appellant's possession (Art. 52 para. 1 APA). Art. 22a para. 1 of the APA on Statutory or Official Periods does not apply (Art. 5 para. 2 TAAA). The appeal has suspensive effect (Art. 19 para. 3 TAAA).

The appeal period starts running on the day following this notification in the Federal Gazette (Art. 14a para. 6 TAAA).
