Communication de l'Administration fédérale des contributions (AFC) ­ Assistance administrative En vertu de l'art. 14a, al. 6, de la loi fédérale du 28 septembre 2012 sur l'assistance administrative internationale en matière fiscale (LAAF; RS 651.1), l'AFC communique ce qui suit: 1.

Par courrier du 23 novembre 2018, l'Agenzia delle Entrate, Ufficio Cooperazione Internazionale, Italie, a adressé à l'AFC une demande d'assistance administrative selon l'art. 27 de la Convention du 9 mars 1976 entre la Confédération suisse et la République italienne en vue d'éviter les doubles impositions et de régler certaines autres questions en matière d'impôts sur le revenu et sur la fortune (CDI CH-IT, RS 0.672.945.41).

Il est demandé de fournir des informations concernant des personnes physiques dont le nom n'est pas connu et qui, durant la période du 23 février 2015 au 31 décembre 2016, remplissent tous les critères suivants: a. La personne était titulaire d'un ou de plusieurs comptes auprès de la banque BSI SA, ou par la suite auprès de la banque EFG Bank AG; b. Le/la titulaire du compte disposait (selon la documentation bancaire interne) d'une adresse de domicile en Italie; c. La banque BSI SA a envoyé au/à la titulaire du compte un courrier déclarant que les prestations bancaires seraient réduites si le/la titulaire du compte ne démontrait pas sa conformité fiscale; d. Malgré l'envoi de ce courrier, le/la titulaire du compte n'a pas fourni de preuve suffisante de sa conformité fiscale à la banque BSI SA, respectivement EFG Bank AG, ni avant ni après l'envoi de ce courrier.

Sont exclus de la transmission, les comptes: a. qui ont été divulgués sur la base de l'accord sur la fiscalité de l'épargne CH-EU; ou b. qui ont été divulgués dans le cadre de l'échange automatique d'informations entre la Suisse et l'Italie; ou c. que le/la titulaire a autorisé la banque BSI SA, respectivement EFG Bank AG, à divulguer dans le cadre du programme italien de déclaration volontaire (Voluntary Disclosure Programm [VDP]); ou d. dont le montant total a été régularisé dans le cadre d'un «scudo fiscale» italien et qui remplissent cumulativement les conditions suivantes («juridical repatriation»): ­ le montant total figurant sur les comptes au moment de la signature de la déclaration anonyme correspondait au montant des avoirs régularisés déclarés dans la déclaration anonyme; et

la déclaration anonyme a été signée par le contribuable, contresignée ainsi qu'estampillée par une institution financière sise en Italie; et ­ aucun nouvel avoir n'a été transféré sur le compte après la signature de la déclaration anonyme, étant entendu que les revenus des avoirs régularisés ne sont pas considérés comme de nouveaux avoirs; et ­ le mandat donné à l'institution financière italienne d'agir en tant qu'agent de retenue à la source (« withholding agent ») et d'intermédiaire financier (« reporting intermediary ») n'a pas été révoqué, à moins qu'un autre mandat n'ait été donné à une autre institution financière italienne et que ce mandat ne comporte une délégation pour effectuer la retenue à la source et les obligations de déclaration vis-à-vis des autorités fiscales italiennes; ou pour lesquels le/la titulaire a apporté la preuve que les actifs figurant sur le/s compte/s concerné/s à la fin de la dernière année fiscale pour laquelle le délai de dépôt la déclaration fiscale est écoulé, ont été déclarés dans la déclaration fiscale correspondante dûment déposée auprès des autorités fiscales italiennes, plus précisément dans le formulaire RW. Si le montant déclaré comme étant détenu auprès d'instituts financiers suisses est supérieur au solde du/des compte/s concerné/s à la fin de la dernière année fiscale, le/la titulaire doit soumettre à l'AFC les relevés bancaires relatifs aux autres actifs détenus auprès d'instituts financiers suisses, afin de permettre à l'AFC de vérifier si les actifs affichés correspondent aux soldes bancaires. Si le montant déclaré comme étant détenu auprès d'instituts financiers suisses est inférieur au solde du/des compte/s concerné/s à la fin de la dernière année fiscale, l'exemption prévue à la présente lettre e) n'est pas applicable; pour lesquels les informations requises ont déjà été transmises aux autorités compétentes italiennes dans le cadre d'une procédure d'assistance administrative précédente.

En date du 10 décembre 2019 (FF 2019 7777), conformément à l'art. 14a, al.

4, LAAF, les personnes concernées par la demande d'assistance administrative italienne ont été informées, sans citation de leurs noms, par publication dans la Feuille fédérale, (a) de la réception et du contenu de la demande, (b) de leur devoir d'indiquer à l'AFC leur adresse en Suisse si elles y sont domiciliées ou de désigner à l'AFC un représentant en Suisse autorisé à recevoir des notifications si elles sont domiciliées à l'étranger ou y ont leur siège, (c) de la procédure simplifiée fixée à l'art. 16 LAAF, et (d) qu'une décision finale sera établie pour chaque personne concernée, respectivement habilitée à recourir, dans la mesure où la personne n'a pas consenti à la procédure simplifiée. Cette information concernait également les personnes habilitées à recourir co-titulaires d'un compte défini sous le chiffre 1 mais qui ne présentaient pas d'adresse de domicile en Italie, ainsi que les successeurs en droit de tout/e titulaire décédé/e d'un compte visé sous le chiffre 1.

Si l'AFC ne peut pas remettre une décision finale aux personnes concernées et/ou personnes habilitées à recourir, elle la leur notifie en la publiant dans la Feuille fédérale sans indiquer de nom, conformément à l'art. 14a, al. 6, LAAF.

En conséquence, l'AFC communique ce qui suit: A la date de ce jour, l'AFC a établi une décision finale concernant chaque personne qui, malgré la notification, n'a ni consenti à la procédure simplifiée au sens de l'art. 16 LAAF, ni communiqué à l'AFC une adresse en Suisse ou désigné un représentant en Suisse autorisé à recevoir des notifications.

Un recours peut être interjeté contre la décision finale correspondante, auprès du Tribunal administratif fédéral, dans le délai de 30 jours suivant sa notification, respectivement la présente publication dans la Feuille fédérale (art. 19 LAAF en relation avec art. 44 et suivants de la loi fédérale du 20 décembre 1968 sur la procédure administrative [PA; RS 172.021] et art. 31 et suivants de la loi fédérale du 17 juin 2005 sur le Tribunal administratif fédéral [LTAF; RS 173.32]). Le recours est à envoyer à l'adresse suivante: Tribunal administratif fédéral, Cour I/Chambre 2, Demande groupée, Case postale, 9023 Saint-Gall. Toute décision précédant la décision finale peut faire l'objet d'un recours avec la décision finale (art. 19, al. 1 LAAF). Le mémoire de recours doit contenir les conclusions, les motifs avec indication des moyens de preuve et la signature de la partie recourante ou de son mandataire. La décision attaquée et les pièces invoquées comme moyens de preuve doivent être jointes, dans la mesure où la partie recourante les possède (art. 52, al. 1, PA). Les dispositions relatives aux féries au sens de l'art. 22a, al. 1, PA ne sont pas applicables (art. 5, al. 2, LAAF). Le recours a effet suspensif (art. 19, al. 3, LAAF).

Le délai de recours court à compter du jour qui suit la notification dans la Feuille fédérale (art. 14a, al. 6, LAAF).

Notice from the Federal Tax Administration (FTA) ­ administrative assistance Based on Art. 14a para. 6 of the Federal Act of 28 September 2012 on International Administrative Assistance in Tax Matters (TAAA, SR 651.1) the FTA makes the following announcement: 1.

By letter dated 23 November 2018 the Agenzia delle Entrate, Ufficio Cooperazione Internazionale, Italy, requests the FTA for administrative assistance based on Art. 27 of the Convention of 9 March 1976 between the Swiss Confederation and the Italian Republic for the Avoidance of Double Taxation with Respect to Taxes on Income and on Capital (DTA CH-IT; SR 0.672.945.41).

Information is requested concerning natural persons, whose names are unknown and who fulfil all of the following criteria during the time period from 23 February 2015 to 31 December 2016: a. The person was an account holder of (an) account(s) with BSI SA or subsequently with EFG Bank AG; b. The account holder had his/her domicile address in Italy (according to internal bank documentation); c. The account holder was sent a letter in which BSI SA informed him/her about restrictions on banking services unless the account holder had provided the bank with proof of his/her tax compliance; d. Despite this letter the account holder did not provide BSI SA or EFG Bank AG ­ neither before nor after this letter ­ with sufficient evidence of his/her tax compliance with regard to the account(s).

Exempt are the accounts: a. which have been disclosed within the framework of the Agreement on the Taxation of Savings between the Swiss Confederation and the European Union; or b. which have been disclosed within the framework of the automatic exchange of information on financial accounts between Switzerland and Italy; or c. for which an authorization regarding the specific account(s) has been provided to BSI SA or EFG Bank AG within the framework of the Italian Voluntary Disclosure Program (VDP); or d. for which the overall amount of the account(s) of the Italian taxpayer held with BSI SA or EFG Bank AG has been regularized within the framework of an Italian «scudo fiscale» and the account(s) fulfil(s) all of the following conditions (so called «juridical repatriation»): ­ the overall amount of the account(s) held with BSI SA or EFG Bank AG at the time of the signature of the anonymous declaration was equivalent to the amount of the Swiss regularized assets indicated on the anonymous declaration; and

the anonymous declaration was signed by the taxpayer and countersigned as well as stamped by a financial institution located in ltaly; and ­ no new money was deposited into the account(s) after the date of signature of the anonymous declaration. Proceeds of regularized assets do not qualify as new money; and ­ the Italian financial institution mandate to act as a withholding agent and a reporting intermediary has not been revoked, unless another mandate to a different Italian financial institution was given and that mandate includes a delegation to perform withholding tax and reporting obligations to the Italian tax authorities; or for which the taxpayer has provided evidence to the Swiss Federal Tax Administration that the assets in the account(s) at the end of the last tax year for which the deadline to hand in the tax return has passed were included in the appropriate tax return duly filed with the Italian tax administration, more specifically in the RW-form. lf the amount declared, as held with Swiss financial institutions, is higher than the account balance at the end of the last tax year of the concerned account(s), the taxpayer has to submit to the Swiss Federal Tax Administration the account statement(s) regarding the other assets with Swiss financial institutions in order to enable the Swiss Federal Tax Administration to examine if the assets declared are equivalent to the account balances. If the amount declared as held with Swiss financial institutions is lower than the account balance at the end of the last tax year of the concerned account(s), the exemption from the communication of the account provided for in this letter e) does not apply; or for which the requested information has already been transmitted to the Italian Competent Authority in a prior administrative assistance procedure.

By publication dated 10 December 2019 (BBl 2019 8223) the persons concerned by the Italian request for administrative assistance were informed anonymously based on Art. 14a para. 4 TAAA (a) about the receipt and content of the request, (b) about the obligation to give the FTA their address in Switzerland if they are resident or domiciled in Switzerland or to designate a person authorized to receive service in Switzerland if they are resident or domiciled abroad, (c) about the simplified procedure in accordance with Art.

16 TAAA, and (d) that a final decree will be issued for each person entitled to appeal who has not consented to the simplified procedure. The same information was also given to the persons entitled to appeal, who are coowners of an account covered by para. 1, but do not have a domicile address in Italy as well as any possible legal heirs of a deceased holder of an account covered by para. 1.

If the FTA is unable to deliver a final decree to persons concerned and/or persons entitled to appeal, it shall notify them of such a decree anonymously via a publication in the Federal Gazette in accordance with Art. 14a para. 6 TAAA.

Accordingly, the FTA informs: Today the FTA has issued a final decree concerning each person who, despite notification, neither consented to the simplified procedure according to Art. 16 TAAA, nor provided the FTA with his/her address in Switzerland or designated a person authorized to receive service in Switzerland.

The corresponding final decree can be appealed to the Swiss Federal Administrative Court within 30 days of its opening respectively of the present notification (Art. 19 TAAA in connection with Art. 44 ff. of the Federal Act of 20 December 1968 on Administrative Procedure [APA; SR 172.021] in connection with Art. 31 ff. of the Federal Act of 17 June 2005 on the Federal Administrative Court [SR 173.32]). The appeal is to be submitted to the following address: Bundesverwaltungsgericht, Abteilung I/Kammer 2, Gruppenersuchen, Postfach, 9023 St. Gallen. Any order that was issued prior to the final decree may be contested with the final decree (Art. 19 para. 1 TAAA). The appeal must contain the claims, the grounds of the appeal including details of any evidence and be signed by the appellant or his/her representative; a copy of the contested final decree as well as any documents cited as evidence must be attached, provided they are in the appellant's possession (Art. 52 para. 1 APA). Art. 22a para. 1 of the APA on Statutory or Official Periods does not apply (Art. 5 para. 2 TAAA). The appeal has suspensive effect (Art. 19 para. 3 TAAA).

The appeal period starts running on the day following this notification in the Federal Gazette (Art. 14a para. 6 TAAA).
